1. THIS IS A CONTRACT

Following are terms and conditions, which govern the sale of product(s) on Mer-maid Products Inc. web site. These terms and conditions are intended to be a legal and binding agreement between Mer-maid Products Inc. including all of its affiliates on this ("Web Site") and you, the user(s). By accessing and browsing this Web Site, you acknowledge that you have read and reviewed the following terms and conditions and that you agree to be bound by them. Mer-maid Products Inc. reserves the right, in its sole discretion, to change these terms and conditions at any time without prior notice.

2. ORDERS

Orders are not binding upon Mer-maid Products Inc. until order acceptance has been made by Mer-maid Products Inc. All payments must be received prior to Mer-maid Products Inc. giving acceptance to the user's order. Mer-maid Products Inc. reserves the right to change payment terms at any time.

3. PAYMENT TERMS

Mer-maid Products Inc. accepts the following payment terms: Visa, MasterCard, American Express and Discover Card. We do accept personal checks. When ordering with personal check shipments will be delayed until your check has cleared for payment. Shipments can be delayed up to four weeks. No C.O.D. orders are accepted.

4. SHIPPING TERMS

Mer-maid Products Inc. ships 95% of our received orders in 12-36 hours and product(s) are received in 2 to 7 business days from date of order, if order is received before 1:00 pm. PST. during normal business hours, Mon.-Fri. 8:00 am - 9:00 pm, PST. We offer a variety of shipping options to meet your shipping needs. Mer-maid Products Inc. uses only premium carriers (UPS, USPS) with Next Day, 2nd Day and Ground delivery options available for many items. Shipping cost is available in the checkout process of your order. We cannot ship to P.O. Boxes. Refused shipments will be charged a 20% restocking fee plus all applicable shipping fees.

5. RETURN POLICY

Mer-maid Products Inc. return policy is very simple. We will gladly accept returns for defective products if notified within 10 days after the user's receipt of product. All returned pro , ducts must have a Return Material Authorization Number on the outside of the package. Products being returned without the proper Return Material Authorization Number on the packaging will be refused and returned back to the user(s), at their cost. All standard returns will be subject to a 20% restocking fee. All freight on returns must be prepaid. All returns will be processed and fully inspected after they arrive back in our facility, before a credit is issued. All returns must include all peripherals accompanied with each product. This includes hardware, manuals, cables, etc. Returns that do not include all peripherals will be returned to the user(s) or charged back to the user(s) on a per item basis. Mer-maid Products Inc. does not accept returns on any opened packaged, electrical parts. All returns are required to be in their original packaging when returned.

6. WARRANTIES; LIMITATION OF LIABILITY

Mer-maid Products Inc. does not involve itself in user-to-user dealings. In the event that you have a dispute with one or more users, you release Mer-maid Products Inc., its agents, and its employees from claims, demands, and damages, actual and consequential of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Mer-maid Products Inc. does not involve itself in users' installation of products and is released by user(s) of any damages, actual and consequential resulting from improper installation of products. This being harm or damages occurred to installation user(s) and all other parties involved or having resulted in damage of their property, bodily injury, including any acts from natural occurrences. Natural occurrences: including but not limited to lighting, earthquakes, wind and flooding, or any other unforeseeable acts of mother nature.

Mer-maid Products Inc. does not involve itself in the manufacturing of all products associated with Mer-maid Products Inc. and web site. Mer-maid Products Inc. is released by user(s) of any damages, actual and consequential resulting from the improper manufacturing of products associated with Mer-maid Products Inc. and web site. User(s) shall release Mer-maid Products Inc., its agents, and its employees from claims, demands, and damages, actual and consequential, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

The product(s) warranty shall be the manufacturer's standard limited warranty for their specific products. All manufacturer warranties may change at any time. Manufacturer warranties are listed with their products on the ordering page. Mer-maid Products Inc. will work with the user(s) to obtain replacement, refund or exchange of product or goods do to a manufacturer's defect in material and workmanship of their associated product or goods.

7. TRADEMARKS AND REGISTERED TRADEMARKS All products or service names mentioned in this Web Site, Server are trademarks or registered trademarks of their respective owners. This Web Site cannot be copied or used without the sole written consent of Mer-maid Products Inc.

8. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between Mer-maid Products Inc. and user(s) pertaining to the subject matter hereof, and supersedes in their entirety any and all written or oral agreements made.
